Songski Terms of Use

These Terms of Use (“Terms”) form a legally binding agreement between you and Songski (“Songski”, “we”, “us”, “our”) governing your access to and use of the Songski website, mobile application, and related services (the “Platform”).
By accessing or using Songski, you agree to be bound by these Terms. If you do not agree, you must not use the Platform.
1. Overview of the Platform
Songski is a live music interaction platform that enables audience members to request songs from performers in real time at participating venues.
The Platform allows:
Audience users to request songs, send tips, and boost requests
Performers (including DJs, bands, and solo musicians) to manage setlists and requests
Venues and event participants to facilitate live audience engagement
Songski is a technology platform only. We do not provide live performances, control performances, or guarantee any performance outcomes.
2. Eligibility
You must be at least 18 years old, or have the consent of a parent or legal guardian, to use the Platform.
We may suspend or terminate access if we reasonably believe eligibility requirements are not met.
3. Account Registration
To use certain features, you must create an account and provide accurate and up-to-date information.
You are responsible for:
Maintaining the confidentiality of your account
All activity occurring under your account
Ensuring your use complies with these Terms
We may suspend or terminate accounts at our discretion where misuse, fraud, or unsafe conduct is identified.
4. Audience Users
Audience users may:
Request songs
Boost song requests (where available)
Send tips to performers
Follow performers and engage with their content
You acknowledge that:
Song requests are requests only
Performers have full discretion over setlists and performances
Boosting or tipping increases visibility but does not guarantee performance
5. Performer Accounts
Performers include DJs, musicians, bands, and other live acts using the Platform to manage audience interaction.
Performers:
Are independent contractors and not employees or agents of Songski
Are solely responsible for their performances and conduct
Control their own setlists and whether to accept requests
May enable or disable request functionality at any time
Songski does not direct, control, or guarantee any performance outcome.
6. Song Requests and Live Performance Model
Songski facilitates a live request queue system.
Important:
All song requests are transmitted to performers as suggestions
Requests are displayed in a queue system
Performers may accept, ignore, reorder, or reject requests at their discretion
Completed requests are removed from the active queue
All performances occur live and independently by the performer.
Songski does not stream, play, or control music playback.
7. Paid Requests, Tips and Boosts
Where paid features are available:
Payments may be used to boost visibility of a request
Tips are voluntary payments to performers
Paid requests are intended to increase likelihood of performance but do not guarantee performance unless explicitly accepted by the performer
If a performer receives a paid request, they are expected to perform it in good faith unless prevented by circumstances including but not limited to:
Safety concerns
Venue restrictions
Technical or practical impossibility
Legal or regulatory restrictions
The song not being reasonably performable by the performer
Where a paid request cannot be fulfilled, the performer should offer an alternative or else refunds or remedies will be handled in accordance with these Terms and applicable law.
8. Payments and Stripe
Payments are processed by third-party payment providers, including Stripe.
You agree that:
Stripe handles payment processing, security, and compliance
Songski does not store full credit or debit card details
Payment disputes, chargebacks, and refunds are primarily handled by Stripe

Songski is not responsible for:
Payment processing failures
Chargebacks or fraud decisions made by Stripe
Errors or delays caused by payment providers
8.1 Songski Service Fees
Songski may deduct a service or platform fee from paid song requests, boosts, tips, and other paid interactions made through the Platform.
Unless otherwise stated in the app, Songski applies a 10% service fee to paid requests, boosts, and tips. Stripe and other payment processing fees, taxes, refunds, chargebacks, currency conversion fees, or other third-party charges may also apply.
Amounts displayed in the app may be estimates or summaries based on available payment data. Final payout amounts, fee calculations, refunds, chargebacks, and payment reports should be confirmed in the performer’s Stripe dashboard.
9. Third-Party Services (Spotify, MusicBrainz and Others)
Songski integrates with third-party services including Spotify and MusicBrainz to provide music metadata, including song titles, artist names, album names, identifiers, and album artwork where available.
Spotify
Songski uses Spotify solely as a music metadata provider. This may include display of track and album metadata and album artwork.
Songski does NOT:
Stream Spotify audio
Reproduce, download, cache, or store Spotify audio content
Provide playback of Spotify content
Control Spotify playback or background apps
When a song is requested or selected in Songski:
No Spotify audio is played
The request is sent to a live performer
The performer independently performs the song live
Spotify content remains the property of Spotify and its licensors.

Songski is not affiliated with, endorsed by, or sponsored by Spotify.
MusicBrainz
Songski may use MusicBrainz as a music metadata database.
MusicBrainz content is provided under its own licensing terms.
MusicBrainz Terms
Songski does not claim ownership of MusicBrainz data and uses it solely for identification and metadata purposes.
Songski also uses service providers including Firebase/Google Cloud for authentication, hosting, database, storage, and cloud functions; Google Sign-In and Sign in with Apple for authentication; Mapbox for venue/location search and mapping; and Stripe for payment processing and connected account services.
Your use of these features may be subject to the relevant third-party terms and privacy policies.
10. Intellectual Property
Songski owns all rights in the Platform, including software, design, branding, and trademarks.
You must not:
Copy, modify, reverse engineer, or exploit the Platform
Use Songski branding without permission
Misrepresent affiliation with Songski
All third-party trademarks (including Spotify and Stripe) remain the property of their respective owners.
11. User Content
Users may submit:
Song requests
Messages
Tips and interactions
Profile content
You grant Songski a worldwide, royalty-free, non-exclusive licence to use this content solely to:
Operate the Platform
Display and transmit requests to performers
Improve and maintain the service
Analyse platform usage
You are responsible for any content you submit.
12. Prohibited Conduct
You agree not to:
Abuse, harass, or threaten performers or users
Attempt to manipulate payments or request systems
Engage in fraudulent activity or chargeback abuse
Use the Platform for unlawful purposes
Interfere with Platform functionality or security
We may suspend or permanently ban users who violate these Terms.
13. Data and Privacy
We collect and process personal data including:
Account information
Usage data
Song requests and interactions
Device and technical information
Payment metadata (processed via Stripe)
We use this data to:
Operate and improve the Platform
Provide analytics and insights
Support safety and fraud prevention
Send service or marketing communications (where permitted)
We comply with the Privacy Act 1988 (Cth). Users may request access or correction of their personal data.
Users may delete their account in the app by going to Settings > Account > Delete Account. Account deletion permanently removes the user’s Songski account access and associated performer profile records, subject to legal, tax, fraud-prevention, dispute-resolution, and security retention requirements.
14. Marketing
Where permitted by law, you may receive marketing communications from Songski.
You may opt out at any time using provided unsubscribe mechanisms.
15. Suspension and Termination
We may suspend or terminate access to the Platform at any time if:
You breach these Terms
Fraud or abuse is suspected
Your behaviour negatively impacts users, performers, or the Platform
Required for legal or safety reasons
16. Service Availability
We do not guarantee uninterrupted access to the Platform.
We may:
Modify features
Suspend services for maintenance
Remove or update functionality at any time
We are not liable for downtime or service interruptions.
17. Limitation of Liability
To the maximum extent permitted by law:
Songski is not liable for:
Loss of income or opportunity
Injuries during live performances
Theft/Damage/Loss of equipment
Unfulfilled song requests
Performer actions or decisions
Audience or venue disputes
Payment or transaction issues caused by third parties
Indirect, incidental, or consequential damages
18. Australian Consumer Law
Nothing in these Terms excludes, restricts, or modifies any rights you may have under the Australian Consumer Law that cannot be excluded.
19. Indemnity
You agree to indemnify Songski against any claims, losses, liabilities, or expenses arising from:
Your use of the Platform
Your breach of these Terms
Your violation of any law or third-party rights
20. Changes to These Terms
We may update these Terms from time to time.
Updated Terms will be posted on the Platform. Continued use constitutes acceptance of the updated Terms.
21. Governing Law
These Terms are governed by the laws of Victoria, Australia.
You submit to the non-exclusive jurisdiction of the courts of Victoria.
